近日,农业农村部办(ban)公(gong)厅、生(sheng)态(tai)环境(jing)(jing)部办(ban)公(gong)厅联合印发《关于进一步(bu)明确畜(chu)禽粪污(wu)还田利(li)用要求强化(hua)养(yang)殖(zhi)污(wu)染监管的通知》(以下简(jian)称《通知》)。农业农村部畜(chu)牧兽医局、生(sheng)态(tai)环境(jing)(jing)部土壤生(sheng)态(tai)环境(jing)(jing)司负责同(tong)志(zhi)围绕《通知》相(xiang)关问题进行解读。

为什么要出台《通知》?

畜(chu)(chu)禽(qin)(qin)(qin)粪肥还(hai)田利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)是(shi)解决畜(chu)(chu)禽(qin)(qin)(qin)养(yang)(yang)殖(zhi)污(wu)(wu)染(ran)问题的(de)(de)根本出路,也是(shi)治本之策。近年来,各地(di)(di)..落实《国务院办公厅关于加(jia)(jia)快推(tui)进(jin)(jin)(jin)畜(chu)(chu)禽(qin)(qin)(qin)养(yang)(yang)殖(zhi)废弃物(wu)资(zi)源(yuan)化(hua)利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)的(de)(de)意见(jian)》,以农用(yong)(yong)(yong)(yong)(yong)有机(ji)肥为主要(yao)利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)方向,强(qiang)化(hua)政策支持引导(dao),加(jia)(jia)强(qiang)实用(yong)(yong)(yong)(yong)(yong)技术推(tui)广,推(tui)动建立市(shi)场(chang)化(hua)机(ji)制(zhi),畜(chu)(chu)禽(qin)(qin)(qin)粪肥还(hai)田利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)取得了阶(jie)段性成(cheng)效。但是(shi),我国种养(yang)(yang)主体分离,种地(di)(di)的(de)(de)不(bu)养(yang)(yang)猪(zhu),养(yang)(yang)猪(zhu)的(de)(de)不(bu)种地(di)(di),种养(yang)(yang)不(bu)匹(pi)配(pei)的(de)(de)问题普遍存在,畜(chu)(chu)禽(qin)(qin)(qin)粪肥还(hai)田利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)“.后一公里”还(hai)没有完(wan)全打通。2019年12月,农业(ye)农村部(bu)办公厅、生态(tai)环境部(bu)办公厅联合印发了《关于促(cu)进(jin)(jin)(jin)畜(chu)(chu)禽(qin)(qin)(qin)粪污(wu)(wu)还(hai)田利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)加(jia)(jia)强(qiang)养(yang)(yang)殖(zhi)污(wu)(wu)染(ran)治理的(de)(de)指导(dao)意见(jian)》,鼓励指导(dao)各地(di)(di)加(jia)(jia)快推(tui)进(jin)(jin)(jin)畜(chu)(chu)禽(qin)(qin)(qin)粪污(wu)(wu)资(zi)源(yuan)化(hua)利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong),畅(chang)通粪污(wu)(wu)还(hai)田渠(qu)道(dao),加(jia)(jia)快畜(chu)(chu)禽(qin)(qin)(qin)养(yang)(yang)殖(zhi)污(wu)(wu)染(ran)防(fang)(fang)治从重达标(biao)排放向重全量利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)转变。为进(jin)(jin)(jin)一步明确粪污(wu)(wu)还(hai)田利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)适用(yong)(yong)(yong)(yong)(yong)标(biao)准,落实养(yang)(yang)殖(zhi)场(chang)户污(wu)(wu)染(ran)防(fang)(fang)治主体责任,强(qiang)化(hua)畜(chu)(chu)禽(qin)(qin)(qin)养(yang)(yang)殖(zhi)污(wu)(wu)染(ran)监管,切实提高畜(chu)(chu)禽(qin)(qin)(qin)养(yang)(yang)殖(zhi)粪污(wu)(wu)资(zi)源(yuan)化(hua)利(li)(li)(li)用(yong)(yong)(yong)(yong)(yong)水平,制(zhi)定(ding)了《通知(zhi)》。

《通知》出台的总体考虑是(shi)什么?
答
一是党(dang)中(zhong)央、国(guo)务(wu)(wu)院(yuan)(yuan)对畜(chu)禽(qin)(qin)废弃物(wu)资(zi)源(yuan)(yuan)化利(li)用(yong)(yong)作出(chu)明确部署(shu)。近年(nian)来,我国(guo)畜(chu)牧业持(chi)续(xu)稳定发展,规模化养殖(zhi)水平逐(zhu)年(nian)提高,保障了肉蛋奶稳定供(gong)给,但部分畜(chu)禽(qin)(qin)粪(fen)污没(mei)有(you)得到有(you)效(xiao)处理和利(li)用(yong)(yong),成为农(nong)村环境治理的一大(da)难题。党(dang)中(zhong)央、国(guo)务(wu)(wu)院(yuan)(yuan)高度重(zhong)视畜(chu)禽(qin)(qin)粪(fen)污资(zi)源(yuan)(yuan)化利(li)用(yong)(yong)工作。2017年(nian)5月,国(guo)务(wu)(wu)院(yuan)(yuan)办公厅印发《关于加快推(tui)进(jin)畜(chu)禽(qin)(qin)养殖(zhi)废弃物(wu)资(zi)源(yuan)(yuan)化利(li)用(yong)(yong)的意见(jian)》。为深(shen)入(ru)贯彻落(luo)实党(dang)中(zhong)央、国(guo)务(wu)(wu)院(yuan)(yuan)决策部署(shu),亟(ji)需进(jin)一步明确畜(chu)禽(qin)(qin)粪(fen)污还田(tian)利(li)用(yong)(yong)要求,科学(xue)有(you)序推(tui)进(jin)粪(fen)污资(zi)源(yuan)(yuan)化利(li)用(yong)(yong)工作。
二是进(jin)一(yi)(yi)步(bu)规(gui)(gui)(gui)(gui)(gui)范(fan)畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)工作的(de)需(xu)要(yao)。畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)是畜(chu)禽(qin)(qin)(qin)养(yang)殖(zhi)业污(wu)染(ran)防(fang)治.为经济(ji)有效的(de)途径(jing)。目前,我国畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)综合利用(yong)率达到75%,规(gui)(gui)(gui)(gui)(gui)模养(yang)殖(zhi)场(chang)粪(fen)(fen)(fen)(fen)污(wu)处理设(she)施装备配套(tao)率达到93%,畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)的(de)步(bu)伐明显加快,有力促进(jin)了畜(chu)牧(mu)业生产与环境保护协调(diao)发展。但(dan)由于缺乏统一(yi)(yi)规(gui)(gui)(gui)(gui)(gui)范(fan)要(yao)求,各地在推进(jin)畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)过程中执行标(biao)准不(bu)一(yi)(yi),资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)不(bu)当而导致环境污(wu)染(ran)的(de)现象时有发生。《通(tong)知(zhi)》进(jin)一(yi)(yi)步(bu)明确了畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)应遵循的(de)技术(shu)规(gui)(gui)(gui)(gui)(gui)范(fan)与标(biao)准,为进(jin)一(yi)(yi)步(bu)规(gui)(gui)(gui)(gui)(gui)范(fan)畜(chu)禽(qin)(qin)(qin)粪(fen)(fen)(fen)(fen)污(wu)资(zi)源(yuan)化(hua)(hua)(hua)利用(yong)提供具(ju)体指导。
三是畅通粪(fen)(fen)(fen)污(wu)(wu)(wu)还(hai)田(tian)(tian)利(li)(li)用渠道的有力(li)(li)保障。目前,我国(guo)畜(chu)禽粪(fen)(fen)(fen)污(wu)(wu)(wu)还(hai)田(tian)(tian)利(li)(li)用标准不..,监管(guan)(guan)体系不健全,实际工(gong)作中还(hai)存在一些误区。在执(zhi)行(xing)标准方(fang)面,将液体粪(fen)(fen)(fen)污(wu)(wu)(wu)作为(wei)肥料利(li)(li)用和(he)作为(wei)灌溉(gai)(gai)水(shui)利(li)(li)用混为(wei)一谈(tan),常(chang)常(chang)要(yao)(yao)求液体粪(fen)(fen)(fen)污(wu)(wu)(wu)必(bi)须达到《农田(tian)(tian)灌溉(gai)(gai)水(shui)质标准》后(hou)才能农田(tian)(tian)利(li)(li)用,极大(da)地阻碍(ai)了(le)(le)畜(chu)禽粪(fen)(fen)(fen)污(wu)(wu)(wu)还(hai)田(tian)(tian)利(li)(li)用。由(you)于(yu)对畜(chu)禽粪(fen)(fen)(fen)污(wu)(wu)(wu)资源化利(li)(li)用缺乏明(ming)确(que)的监管(guan)(guan)执(zhi)法(fa)依据(ju),地方(fang)管(guan)(guan)理部门更加倾向选择易于(yu)监管(guan)(guan)的治理方(fang)式(shi),也不利(li)(li)于(yu)畜(chu)禽粪(fen)(fen)(fen)污(wu)(wu)(wu)资源化利(li)(li)用工(gong)作的开展。《通知》明(ming)确(que)了(le)(le)畜(chu)禽粪(fen)(fen)(fen)污(wu)(wu)(wu)还(hai)田(tian)(tian)应执(zhi)行(xing)的标准以及将粪(fen)(fen)(fen)污(wu)(wu)(wu)处理和(he)粪(fen)(fen)(fen)肥利(li)(li)用台(tai)账作为(wei)监督执(zhi)法(fa)的重(zhong)要(yao)(yao)依据(ju),为(wei)畅通粪(fen)(fen)(fen)污(wu)(wu)(wu)还(hai)田(tian)(tian)渠道,同(tong)时防范环(huan)境风险提(ti)供了(le)(le)有力(li)(li)保障。

《通知》的主要内容有哪些?

《通(tong)知》明确,..鼓励畜(chu)禽粪污还(hai)田利用(yong),支(zhi)持养殖场户建设畜(chu)禽粪污处(chu)理和利用(yong)设施。已获得(de)环(huan)(huan)评批复的(de)规模养殖场如(ru)需由达标(biao)排放(fang)(含(han)按(an)农田灌溉水标(biao)准(zhun)排放(fang))变(bian)更(geng)为资源化利用(yong)(不(bu)含(han)商业化沼气工(gong)程和商品有机肥生产),如(ru)在(zai)项(xiang)目竣工(gong)环(huan)(huan)保验(yan)(yan)收(shou)前(qian)变(bian)更(geng),按(an)照非重大(da)变(bian)动纳(na)入竣工(gong)环(huan)(huan)境保护(hu)验(yan)(yan)收(shou)管(guan)理;在(zai)竣工(gong)环(huan)(huan)保验(yan)(yan)收(shou)后变(bian)更(geng)的(de),按(an)照改建项(xiang)目依法(fa)开展环(huan)(huan)评。
《通知(zhi)》要(yao)求,畜(chu)禽粪(fen)污的处(chu)理应根据排放(fang)去向(xiang)或(huo)利用方式的不同执行相应的标准规(gui)范。作为(wei)肥(fei)料利用应符(fu)合《畜(chu)禽粪(fen)便无(wu)害化处(chu)理技(ji)术(shu)规(gui)范》《畜(chu)禽粪(fen)便还田(tian)技(ji)术(shu)规(gui)范》《畜(chu)禽粪(fen)污土(tu)地(di)(di)承载力(li)测算(suan)技(ji)术(shu)指(zhi)南》。向(xiang)环境排放(fang)的,应符(fu)合《畜(chu)禽养殖业(ye)污染物排放(fang)标准》和地(di)(di)方有关排放(fang)标准。用于农(nong)(nong)田(tian)灌(guan)溉的,应符(fu)合《农(nong)(nong)田(tian)灌(guan)溉水质标准》。

一是畜(chu)禽(qin)粪(fen)(fen)污(wu)无害(hai)化处理(li)应符(fu)合(he)《畜(chu)禽(qin)粪(fen)(fen)便无害(hai)化处理(li)技术规(gui)范》。为(wei)..畜(chu)禽(qin)粪(fen)(fen)污(wu)处理(li)后作(zuo)为(wei)粪(fen)(fen)肥..利用,要求(qiu)液体粪(fen)(fen)肥的蛔虫卵(luan)、钩虫卵(luan)、粪(fen)(fen)大肠菌群数、蚊(wen)子苍蝇四项卫生(sheng)学(xue)指标(biao)应符(fu)合(he)《畜(chu)禽(qin)粪(fen)(fen)便无害(hai)化处理(li)技术规(gui)范》规(gui)定的液体畜(chu)禽(qin)粪(fen)(fen)便厌(yan)氧处理(li)卫生(sheng)学(xue)要求(qiu)。
二是畜(chu)(chu)禽(qin)粪(fen)污无害化处(chu)(chu)理(li)后作为粪(fen)肥(fei)还(hai)田可参考《畜(chu)(chu)禽(qin)粪(fen)便还(hai)田技术规范》的施用方法,选择适宜的施用时间。畜(chu)(chu)禽(qin)粪(fen)污处(chu)(chu)理(li)和(he)畜(chu)(chu)禽(qin)粪(fen)肥(fei)施用过程中(zhong),应采(cai)取必要措施,减少(shao)养分损失(shi),..环境影(ying)响。

粪污(wu)经处理后向环(huan)境排(pai)放(fang)应(ying)符(fu)合(he)《畜(chu)禽养殖(zhi)业污(wu)染(ran)物(wu)排(pai)放(fang)标准(zhun)(zhun)》和(he)地方有(you)关排(pai)放(fang)标准(zhun)(zhun)。养殖(zhi)场(chang)户应(ying)根(gen)据不同工艺满足(zu)相(xiang)(xiang)应(ying)的.高允(yun)许(xu)(xu)排(pai)水量及.高允(yun)许(xu)(xu)日(ri)均排(pai)放(fang)浓(nong)度要求。必(bi)须设(she)置废(fei)渣的固(gu)体储存设(she)施和(he)场(chang)所,且要有(you)防止粪液渗漏(lou)、溢流(liu)措施。用(yong)于(yu)直接还田的畜(chu)禽粪便,必(bi)须进行无害(hai)化处理,且符(fu)合(he)相(xiang)(xiang)应(ying)卫(wei)生学指标。恶(e)臭污(wu)染(ran)物(wu)排(pai)放(fang)应(ying)执行臭气(qi)浓(nong)度标准(zhun)(zhun)。用(yong)于(yu)农田灌溉的,应(ying)符(fu)合(he)《农田灌溉水质标准(zhun)(zhun)》和(he)地方制(zhi)定的严于(yu)该标准(zhun)(zhun)的相(xiang)(xiang)关控制(zhi)项目。

作为养殖场户应承(cheng)担哪些责任?
答
一是畜禽养(yang)殖(zhi)场户应切(qie)实(shi)履(lv)行粪污(wu)(wu)(wu)(wu)(wu)收(shou)集(ji)处(chu)理利用和污(wu)(wu)(wu)(wu)(wu)染(ran)防治主体(ti)责任,采取措施(shi),对畜禽粪污(wu)(wu)(wu)(wu)(wu)进(jin)行科学处(chu)理和资(zi)源化(hua)利用,防止(zhi)污(wu)(wu)(wu)(wu)(wu)染(ran)环境。对于自行处(chu)理利用畜禽粪污(wu)(wu)(wu)(wu)(wu)的(de),应建设(she)(she)与养(yang)殖(zhi)规模(mo)匹配的(de)粪污(wu)(wu)(wu)(wu)(wu)无害化(hua)处(chu)理设(she)(she)施(shi)并..其正常运行;对于委托第三(san)方代为实(shi)现粪污(wu)(wu)(wu)(wu)(wu)无害化(hua)处(chu)理和资(zi)源化(hua)利用的(de),应配套粪污(wu)(wu)(wu)(wu)(wu)收(shou)集(ji)和暂存设(she)(she)施(shi)设(she)(she)备(bei),..粪污(wu)(wu)(wu)(wu)(wu)在(zai)第三(san)方收(shou)集(ji)期间的(de)存储容积。
二是畜禽规模养殖场(chang)应建(jian)设(she)粪(fen)(fen)污无害(hai)化处理(li)(li)和资源(yuan)化利用(yong)设(she)施并..其正常运(yun)行(xing)。粪(fen)(fen)污贮存(cun)设(she)施总容积(ji)不得(de)低于当(dang)地(di)农林(lin)作物生(sheng)产用(yong)肥的(de)(de).大间(jian)隔(ge)时间(jian)内产生(sheng)粪(fen)(fen)污的(de)(de)总量,配(pei)套土地(di)面积(ji)不得(de)小于《畜禽粪(fen)(fen)污土地(di)承载力测算技术(shu)指(zhi)南》要求的(de)(de).小面积(ji);对于配(pei)套土地(di)面积(ji)不足的(de)(de),应委(wei)托第三方代为实现粪(fen)(fen)污资源(yuan)化,或进行(xing)污水深(shen)度处理(li)(li)后(hou)达标排放。
三(san)是(shi)规模(mo)养(yang)殖场应(ying)制定粪肥还田利用(yong)计划并建立台账(zhang)。

一是农(nong)业农(nong)村部门应加强畜(chu)禽(qin)粪污还田技(ji)术指导(dao)和服务,指导(dao)建设粪污资源(yuan)(yuan)化利(li)用(yong)配套(tao)设施(shi)(shi)(shi)等。鼓励(li)养(yang)殖场户(hu)全(quan)量收(shou)集和利(li)用(yong)畜(chu)禽(qin)粪污,根据(ju)实际情况选(xuan)择合(he)理的(de)输送和施(shi)(shi)(shi)用(yong)方式。因(yin)地制宜,推行经济..的(de)粪污资源(yuan)(yuan)化利(li)用(yong)技(ji)术模式,推广全(quan)量机械化施(shi)(shi)(shi)用(yong)。
二是(shi)农(nong)业农(nong)村部门(men)应(ying)加强技术和装(zhuang)(zhuang)备(bei)支撑,包括畜禽粪污(wu)全(quan)量收(shou)集技术与装(zhuang)(zhuang)备(bei),粪污(wu)..输送、施用技术与装(zhuang)(zhuang)备(bei)的(de)研发(fa)及推广,着力破除粪污(wu)资源化利用过程中(zhong)的(de)技术和成本障碍。
三是生(sheng)态环(huan)境(jing)部门负责(ze)畜(chu)禽养(yang)殖(zhi)(zhi)(zhi)污染(ran)防(fang)(fang)治的统一监督(du)管理(li),应依据(ju)职(zhi)责(ze)对畜(chu)禽养(yang)殖(zhi)(zhi)(zhi)污染(ran)防(fang)(fang)治情况进(jin)行监督(du)检查,并加强对畜(chu)禽养(yang)殖(zhi)(zhi)(zhi)环(huan)境(jing)污染(ran)的监测。对于排(pai)放(fang)畜(chu)禽养(yang)殖(zhi)(zhi)(zhi)废(fei)弃物不符合..或(huo)(huo)者(zhe)地方规定的污染(ran)物排(pai)放(fang)标准,或(huo)(huo)者(zhe)未经无害化处(chu)理(li)直接向环(huan)境(jing)排(pai)放(fang)畜(chu)禽养(yang)殖(zhi)(zhi)(zhi)废(fei)弃物的,由县级以上生(sheng)态环(huan)境(jing)部门依法(fa)作出处(chu)罚(fa)。
